المستخلص This dissertation is entitled “Civil Liability of Electronic Authentication Service Providers - A Comparative Study”. The dissertation has been divided into three chapters preceded by an introductory one. The introductory chapter addresses what is meant by the civil liability of electronic authentication service providers, the legal nature of the civil liability of electronic authentication service providers, and the concept of electronic authentication services. The first chapter tackles providing electronic authentication services in Egyptian and comparative law, and the obligations related to providing electronic authentication services in Egyptian and comparative law. The second chapter handles the liability of electronic authentication service providers in accordance with the general rules in the Egyptian law. The chapter discusses the contractual liability of electronic authentication service providers, the tort liability of electronic authentication service providers, and the means of exemption from civil liability for electronic authentication service providers. The third chapter examines the civil liability of electronic authentication service providers in accordance with the special rules and the legal implications of that liability. The chapter investigates the civil liability of electronic authentication service providers in accordance with the special rules in some foreign legislation and some Arab legislation, and the legal implications of civil liability for authentication service providers. The chapter addresses the compensation imposed on electronic authentication service providers, whether it is a consensual compensation by the will of the contracting parties, or a judicial compensation by virtue of a court ruling, with the commitment of the electronic authentication service provider to conclude an insurance contract against the risks of civil liability. The research has been concluded by a conclusion outlining the most important findings and recommendations revealed by the research. |
