This research began after several recent events and situations; not only in Egyptian and Arab society; In Western societies, these events, as a whole, focus on the denial of freedom of expression, and even amount to complacency in the use and improper use of those rights and freedoms.
It is therefore imperative to clarify the great importance of freedom of opinion and expression, which is the parent of all other freedoms of mind, which are rooted in freedom of opinion and which allow the human person to have a special say in all the issues and events before him; It is equally his view that he should support or oppose them, and be critical of their actions.
It will be clear from this research that freedom of opinion and expression includes new images and modern problems; Freedom of opinion has multiple images and applications; Some may be regarded as images of them, others as instruments and instruments for the exercise of freedom of opinion, and also as both images and instruments of practice.
They include the right to receive information, to send it through the various modern media with appropriate freedom, and freedom of opinion is closely linked to the governing practices of all media; These include, of course, guarantees of freedom of the read, audio and video press, and we can also add new sources to these sources; the Internet and social visual and audio media, which have become widespread and widespread in recent times; Even in the most recent judgement of the European Court of Human Rights, these new sources are called citizen journalism.
Freedom of expression has many forms; There are also many ways in which freedom of expression can be exercised. These include Internet networks, social networks.
Social media as one of the mechanisms for expressing opinion on the Internet has entered a dangerous juncture; even became an instrument for destabilizing States; in particular developing countries; What measures have States taken to thwart any schemes that might stabilize them, while at the same time ensuring that individuals can use these sites safely from perverted or extremist ideas.
While everything must be based on it, the existence of freedom of opinion and expression has been based on many grounds. The constitutional basis is one of the most important for freedom of opinion.
Islamic law also guaranteed freedom of opinion and expression to all people; Because it’s based on the work of thinking and thinking about all things of life. We find that Islamic law has gone even further; It has made the freedom of opinion and expression not only a right but a duty of man in all matters affecting the public interest, morality and order, and everything considered to be in the view of Islamic law a denial.
Although there are many constitutional and legal texts, charters and international treaties that ensure the existence of these rights and freedoms, including freedom of opinion and expression, the standard is not the existence of such legislative texts; It’s the most useful, and most important, to apply them, There should therefore be many guarantees that such texts would be applied and that freedom of opinion and expression would be exercised properly.
Constitutional guarantees play a prominent role in protecting the right to express opinion, constitutional law establishes the basic general principles of the State and establishes various freedoms; These include freedom of opinion and expression, freedom of assembly and the right to privacy, either how to proceed and the limits of its exercise; It’s up to law enforcement.
The Supreme Constitutional Court also plays an important and prominent role in protecting the right to expression; by monitoring the constitutionality of laws and regulations; In particular, in the area of public rights and freedoms, which is a very important way of affirming the primacy of the Constitution and protecting constitutional legality. This is like the power of public opinion and the creation of economic, cultural and social conditions that give public freedoms a realistic concept.
While guarantees for the exercise of freedom of opinion and expression are necessary, public rights and freedoms - including freedom of opinion and expression - are subject in their exercise to a number of controls and restrictions that limit the arbitrary exercise of public rights and freedoms; It cannot be left to everyone to exercise. Otherwise, freedoms turn into chaos, threats and attacks on the rights and freedoms of others.
While freedom of opinion and expression gives individuals the right to express their opinions and to express their beliefs and ideas, there is no freedom without limitations or limits, there is no freedom without responsibility, otherwise freedom becomes chaos; Freedom of expression - as a public freedom - without restrictions on its exercise - in situations defined by law, becomes slander, offends the freedoms of others and becomes irresponsible; The exercise of freedom of opinion and expression depends on that freedom not being an attack on the rights of others to enjoy their general rights and freedoms.
The importance of freedom of opinion and expression does not allow it to be unleashed; The exercise of this freedom by any person may be detrimental to others and to the higher interests of society; This has led to the need for strong and disconnected controls to balance freedom of opinion and expression; As one of the most important and all-important public freedoms and human rights - the preservation of the rights and freedoms of individuals, without prejudice to international human rights conventions and covenants.
